We do not warrant that the Site will be uninterrupted, secure, timely, error-free, or free from harmful components.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SURF SIGMA INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SURF SIGMA INC. FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED CAD $100.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Surf Sigma Inc. and its officers, directors, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses—including reasonable legal fees—arising from your misuse of the Site, violation of these Terms, or violation of another person’s rights.
Governing law and venue
These Terms and any dispute arising out of or relating to the Site or these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.
You and Surf Sigma Inc. irrevocably attorn to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada for any dispute arising out of or relating to these Terms or the Site. An exclusive jurisdiction clause selects one jurisdiction’s courts rather than merely permitting that jurisdiction as an option.

We may revise these Terms at any time by posting an updated version on this page. The “Last updated” date will identify the latest revision. By continuing to use the Site after the revised Terms are posted, you agree to the revised Terms.
